#510: Can I take someone else photo or design and use in my design or work?

When talking about copyright it is good to remind that derivative works are usually not permitted, for example you cannot take a photograph and make a painting based on that; that would be infringement. You cannot take an image, transform, distort, invert, dither, adapt, scale, clip, crop and claim you have something new; in legal terms you would be infringing copyrights of the initial creators; you would be copying. In some countries taking photos of art works and even products and to some extend, taking photos of architectural works are considered copyright infringements. However in patents, you could make derivative product as long as there is enough derivation that makes your new product significantly different, i.e. a difference quickly observable by buyers in the market. In any cases, please consult with and seek help from an intellectual property lawyer.
